→ Their success comes from a smart ambassador program, focusing on fitness coaches / athletes and lifestyle creators.
However, even the best strategies can face challenges when contracts are not carefully managed.
The case
22-year-old powerlifter Nathaniel Massiah, a former Gymshark ambassador, promoted competitor YoungLA soon after his Gymshark contract ended.

The issue? Gymshark alleges he violated a non-compete clause prohibiting collaborations with competitors for three months post-contract.
According to recent reports, the company and the creator found an agreement to resolve this legal issue. BUT
This lawsuit raises challenging questions:
Is it fair for creators? Or is it necessary for brand protection?
Small creators are often hit hardest in legal fights.
Clear contracts are a must to avoid confusion.
Influencers need better legal advice upfront.
Here’s why you must learn from this failed campaign:
Key Lessons for Brands & Marketers
1️⃣ Crystal Clear Contracts
Contracts should clearly explain non-compete clauses and other key terms. Use plain language to avoid confusion. Non-compete clauses can protect brands but must be reasonable to ensure fairness.
→ Learn More to discover how clear contracts can protect your brand and foster better partnerships.
2️⃣ Educate Your Partners
Influencers often don’t fully understand contract terms. Walk them through the key points. Education ensures fewer disputes and better partnerships.
3️⃣ Avoid PR Pitfalls
Legal battles can damage a brand’s image. Consider mediation or alternative solutions first. A public lawsuit could harm both parties in the long run.
4️⃣ Build Long-Term Trust
Invest in relationships that foster mutual respect. Focus on transparency and fairness to create loyal, lasting partnerships.
